Dean’s Discipline Procedures
- Notice of the Charges by Office of Dean for Student Affairs
- Ordinarily in writing
- Specifies nature of charges
- Requires student to attend a disciplinary hearing
- Opportunity to be Heard (Hearing)
- Student informed of evidence
- Student asked to respond
- Student right to offer own evidence including:
- other relevant witnesses
- relevant documents
- written submission
- Fact-finding rather than adversarial courtroom-type proceedings:
- Attorneys not present (although students are free to consult attorneys)
- No formal cross-examination of witnesses or objecting to evidence.
- Written Determination After Hearing
- Right to Appeal to the Dean of the College of Physicians and Surgeons
- Appeal must be made within [7] days of student’s notification of determination.
- Appeal must be in writing and clearly state grounds for appeal.
- Normally, Dean considers only written record; no new factual investigation.
- Standard of appeal: Whether decision made and discipline imposed are reasonable under all of the circumstances.
- No further appeal within the University.
